The Vulnerable Adult Protection Order, a new legal remedy adopted by the Legislature and signed into law by the Governor in 2016, is designed to protect vulnerable elders and adults with a disability from physical and emotional abuse, neglect, or financial exploitation at the hands of family members, friends, and other close associates. The law relevant to this new protection order can be found at SDCL chapter 21-65.

These forms can assist you in seeking a protection order for yourself, if you are a person over age 65 or an adult with a disability and are unable to protect yourself from abuse, neglect, or financial exploitation. These forms can also assist spouses, relatives, household members, caregivers, or fiduciaries of the vulnerable adult in seeking a protection order on the vulnerable adult’s behalf as a substitute petitioner.
